SolarWorld : In 'win for Oregon,' feds uphold steep tariffs on Chinese solar products

07/08/2015 | 11:17pm US/Eastern

July 08--SolarWorld Industries America Inc. claimed another round Wednesday in its long-running trade fight against Chinese solar panel manufacturers.

As part of an annual review, the U.S. Commerce Department upheld steep tariffs on solar cells imported from China. The final decision reverses the agency's initial plans to slash the duties by nearly half.

Many manufacturers now face anti-dumping and anti-subsidy duties of 31 percent on solar cells made in China.

The tariffs stem from a 2011 trade complaint lodged by SolarWorld, the German company that employs hundreds of people at a solar-panel factory in Hillsboro.

"This is another strong victory for U.S. solar manufacturers and workers as Commerce's trade investigators once again found that China's improper trade practices violate U.S. trade law," said SolarWorld's U.S. president, Mukesh Dulani, in a statement.

Sen. Ron Wyden, D-Ore., described the decision as a "win for Oregon workers" in a message posted on the social media platform Twitter.

When SolarWorld first filed the trade case, it was struggling to survive. Executives contended Chinese companies were flooding the U.S. solar industry with below-cost products subsidized by their government.

The glut of cheap panels collapsed prices -- and many U.S. manufacturers.

Federal trade officials sided with SolarWorld in 2012 and placed steep penalties on imports. A second, related case also went in SolarWorld's favor in 2014 and resulted in further tariffs.

The European Union has imposed similar duties.

Tensions flared between SolarWorld and its Chinese competitors while the trade dispute played out in the U.S. and Europe.

Federal prosecutors allege SolarWorld was targeted by hackers during the early phases of the trade case. Five Chinese military officials were indicted in May 2014 on charges that they hacked into SolarWorld and a handful of other U.S. firms. The men were declared fugitives in October. The case has been on hold since.

Executives say SolarWorld has rebounded since launching the trade cases. The company expanded earlier this year in Hillsboro and increased its workforce from 700 to 900 to meet growing demand.
